Information for preparation of Agreement for Sale and Purchase

This information is required to complete an Agreement for Sale and Purchase. If in doubt, leave the box blank, and discuss it with us.

Name of Vendor/Seller

The names that appear on the title to the property (can be found on Council rate notice).

Address of Property

Street address and suburb.

Name of Purchaser / Buyer

The names of the purchaser/s if known.

Purchase Price

The price you want for the property. Unless you state otherwise it will be inclusive of GST (if any).


Traditionally 10% of purchase price but more commonly between 5% and 10% of purchase price.

Interest rate for late settlement

The rate of interest paid by a defaulting party to an innocent party in the event of default. e.g. 14%

Possession Date

The date that you hand over possession to the purchaser. This can either be a fixed date or a number of working days (often 10) from the date of confirmation of any conditions.


Is the property currently tenanted?

If yes is the property to be sold subject to the tenancy?

If yes the following needs to be completed.

Amount of Rent

(per week/fortnight?)


(Normally fixed to a particular date or periodic i.e. no fixed date)

If no the possession date will have to be at least 42 days from confirmation to enable notice to quit to be given to the tenant.


Add in any other chattels to be included in the sale.
For example: Dishwasher, heated towel rail(s), gas heater/s, rangehood.
